Forensic Consulting in the Fallout of Yamagiwa v. City of Half Moon Bay
As a layperon coursing through the routines of everyday life, one would not ordinarily contemplate that their local government might be depriving citizens of their Unalienable Rights. That was in fact exactly the case a few years back in the City of Half Moon Bay. The City of Half Moon Bay's environmental agenda was realized at a near catastrophic cost when Chief Judge Vaughn Walker of the US District Court for the Northern District of California handed down his decision on Yamagiwa v. City of Half Moon Bay (N.D. Cal. 2007) 523 F.Supp.2d 1036. The court held that the City was liable for inverse condemnation, the taking of private property for public use without just compensation. As stated in the Fifth Amendment, U.S. Constitution, "...nor shall private property be taken for public use, without just compensation."
